Respecting and promoting human rights in the NDIS Sector
As a regulator, our role is to improve the quality and safety of NDIS supports and services. At the NDIS Commission, Human Rights are central to our decision making and how we work with participants. In order for The NDIS Commission to lead by example and strengthen its focus on protecting the human rights of NDIS participants we have developed and published a guidance paper which describes how we have embedded human rights principles and duties in our regulatory approach.
Last year the NDIS Commission worked with the Australian Human Rights Commission (AHRC) to consider how the NDIS Commission could further enhance its human rights approach as a regulator.
Our work will be informed by:
- The FREDA principles – Fairness, Respect, Equality, Dignity and Autonomy[1]; and
- The PANEL principles – Participation, Accountability, Non-Discrimination and Equality, Empowerment and Legality[2].
- UN Convention on the Rights of Persons with Disabilities (CRPD).
A set of duties and action statements will be included in the NDIS Commission's operational and strategic plans, and will be built in our day-to-day work processes.
Update: The NDIS Commission has developed an internal Human Rights Guidance paper to support enhancement of organisational culture and amplification of human rights in administrative practice and policy development.
