When the NDIS Commission takes an enforcement action against a provider or worker, it is recorded in Part 2 of the NDIS Provider Register. 

To help you make an informed decision about who you employ or work with, you can search the register and see if a provider or worker has received any current or past enforcement actions.

The online search lists compliance and enforcement actions that have been given to providers or workers.

Compliance and enforcement actions search

The search includes:

  • banning orders – when the NDIS Commission stops or restricts a provider from providing specific supports or to a person with disability, either permanently, temporarily or conditionally
     
  • compliance notices – a written direction given to a provider or worker requiring them to comply with the rules by taking or not taking specific actions, and when appropriate providing evidence that the notice requirements have been met 
     
  • enforceable undertakings – a written commitment by a provider or worker stating they will take or not take specific actions to make sure they are complying with the rules
     
  • suspension or revocation of registration – temporarily or permanently taking away the registration of a provider who is registered with the NDIS Commission.

The search doesn’t include:

  • infringement notices – a financial penalty for a provider or worker
     
  • low-level actions like warning letters and when providers or workers are asked to adjust their practices
     
  • civil proceedings – in some cases the Commission will take civil action against a provider or worker that is additional to the initial enforcement actions. The civil action is not available in the search, but the initial enforcement action will be
     
  • some instances where it is not in the interest of the public or a participant to publish details of a compliance action.

The register is published under section 73ZS of the NDIS Act and in accordance with the NDIS (Provider Registration and Practice Standards) Rules 2018.
