Ask for a decision to be reviewed

If you’re not happy with certain NDIS Commission decisions, you can ask us for an internal review within 3 months of receiving the decision.

There is no cost involved.

This process does not apply to complaints about our staff or processes.

 

Decisions which can be reviewed

Registration decisions

A decision to:

  • refuse to register an NDIS provider
  • impose conditions on an NDIS provider’s registration
  • vary, or refuse to vary, an NDIS provider’s registration
  • suspend an NDIS provider’s registration
  • revoke, or not revoke, an NDIS provider’s registration.

Compliance notices

A decision to:

  • give a compliance notice to an NDIS provider
  • vary or revoke a compliance notice.

Banning orders

A decision to:

  • make a banning order
  • vary, or refuse to vary or revoke, a banning order.

Who can ask for a review

Anyone who is directly affected by the decision can ask for an internal review.

This may include:

  • the person who received the notice of the decision (for example, a worker, company or provider that received a compliance notice, or banning order or registration decision)
  • key personnel of a provider or company, or
  • a worker or company affected by the decision.

The internal review process often involves highly-sensitive and confidential information. If a legal representative is acting on your behalf, we will ask them to prove that you have agreed to let them represent you. If evidence is not provided, we may refuse to accept your review request.

How to request a review

You can also withdraw a request for internal review by emailing or calling the NDIS Commission.

If you have already had a decision on an internal review, you cannot ask for another one.

The review process

1. We’ll check if your request can be accepted

We may ask for further information regarding your request, including where someone else is representing you.

2. We’ll let you know that we’ve received your request

You’ll have the opportunity to make further submissions at this time.

3. The reviewer will consider the decision again along with any further information you provide. They may ask you for more information.

4. We’ll let you know the outcome. The original decision will either be:

  • upheld
  • varied, or
  • replaced with a new decision.

You’ll get a decision within 90 days of your request being accepted.

The NDIS Commission cannot pause a decision or delay it from taking effect, even if it is under an internal review.

Requesting an external review

If you’re unhappy with the outcome of the internal review, you can apply to the Administrative Review Tribunal (ART) for a review of the NDIS Commission’s decision.

You must make your application to the ART within 28 days of receiving the notice of the review decision.
